Pontos-chave

Article 123 (Dimensioning parameters): Requires that subdivision operations and urban operations considered by municipal regulation as relevant impact or similar to subdivision provide areas for green spaces and collective-use facilities, and road infrastructure. The parameter for green spaces and collective-use facilities is 0,40 m2 of land per m2 of total construction area; in economic activity areas it is 0,20 m2 of land per m2 of total construction area. Dispensation or lower areas are only allowed if duly justified. - area for green spaces and collective-use facilities: 0,40 m2 de terreno por m2 de área total de construção - area for green spaces and collective-use facilities (economic activity areas): 0,20 m2 de terreno por m2 de área total de construção Article 124 (Assignments): Provides that plots corresponding to green spaces, collective-use areas and collective-use facilities resulting from subdivision operations and relevant or significant impact urban operations are integrated into municipal domain when necessary or sufficient to meet needs and the public interest. If the areas to be transferred fall short of the dimensioning parameters in the previous article, compensation to the municipality is due. For green-space plots to be transferred, at least 75 % of the total area must form a single non-discontinuous plot, no parcel smaller than 200 m2 or narrower than 5 meters is admissible within public streets, and they must have direct access to public space or road. - minimum green-space plot share: 75 % - minimum green-space plot area: 200 m2 - minimum green-space plot width: 5 meters Article 22 (Aesthetic, environmental and landscape conditions): Allows the municipality to impose architectural, construction, aesthetic or environmental conditions to ensure correct integration in the surroundings or to protect and promote architectural, environmental and landscape values.
